Terms and Conditions of Sale (T&Cs)
Article 1 – Scope of Application
These Terms and Conditions of Sale (hereinafter "T&Cs") apply without restriction or reservation to all sales concluded between Fleurs d’hiver Ltd, a company registered in the United Kingdom under company number 14711415, with its registered office at Onega House, 112 Main Road, Sidcup, United Kingdom, DA14 6NE, and its professional clients (hereinafter "Resellers") or individual clients (hereinafter "Customers").
These T&Cs apply equally to professionals and individuals, with detailed provisions where necessary.
These T&Cs are available at all times on the website www.fleursdhiver.com and may be modified at any time by Fleurs d’hiver Ltd. The applicable terms are those in force on the date of order confirmation. Any order implies the unconditional acceptance of these T&Cs.
Article 2 – Purpose
These T&Cs define the rules governing the sale of infusion products, presented in the form of honey and flower lollipops, as well as any other associated products (tableware, displays). They set out the rights and obligations of the parties:
- Establishment of the contractual relationship between Fleurs d’hiver Ltd and the Customer;
- Conditions for ordering, payment, delivery, and claims.
Article 3 – Orders
Orders can only be placed via an order form sent by email to info.fleurs.dhiver@gmail.com. Customers, whether professional or individual, must ensure the accuracy of the information provided when placing an order.
Once validated, the order is confirmed by email, including an order summary in the form of a pro forma invoice or quotation, along with payment details and delivery terms. Individuals may place orders for personal or event-related use, such as weddings.
Order validation implies acceptance of these T&Cs. The order is confirmed upon receipt of payment. In case of errors or modifications before validation, the Customer must immediately contact Fleurs d’hiver Ltd. Orders are final once payment has been confirmed.
Article 4 – Prices
Product prices are expressed in British pounds (GBP) and include all applicable taxes. Delivery costs are specified at the time of ordering and vary depending on the destination and the quantity of products ordered.
Article 5 – Payment
Orders must be paid in British pounds (GBP) and are due upon receipt of the pro forma invoice. No payment deferrals are granted, whether for professionals or individuals.
Payments can be made by:
- Bank transfer (details provided at the time of order).
Article 6 – Delivery
6.1 – Delivery Areas
Fleurs d’hiver Ltd delivers worldwide. Delivery times and costs vary depending on the destination and will be indicated before order confirmation.
6.2 – Damaged Products During Transport
If a parcel arrives damaged, the Customer must:
- Immediately check the condition of the products and packaging in the presence of the courier.
- Note specific reservations on the delivery receipt (e.g., "damaged package," "broken product").
- Confirm these reservations in writing to the courier within 48 hours via a registered letter.
The Customer must also inform Fleurs d’hiver Ltd within 48 hours of receipt by sending proof (photos of the damage and packaging) to info.fleurs.dhiver@gmail.com.
After evaluation, Fleurs d’hiver Ltd may:
- Replace the damaged products at no additional cost;
- Or issue a refund if a replacement is not possible.
6.3 – Customs Duties
For deliveries outside the United Kingdom, customs duties or other local taxes may apply upon entry into the destination country. These charges are the sole responsibility of the Customer. The Customer must inquire about these fees with local authorities before placing an order. If a product is refused by customs and returned to Fleurs d’hiver Ltd, the Customer remains responsible for the order and no refund will be issued.
6.4 – Delivery Times and Address Accuracy
Once the parcel has been collected by the courier, Fleurs d’hiver Ltd cannot be held responsible for any delivery delays caused by the courier. The Customer must directly contact the courier for any claims regarding delivery times.
The Customer is responsible for providing a correct and accessible delivery address. If delivery fails due to an incorrect, incomplete, or inaccessible address, reshipping costs will be borne by the Customer. If the parcel is returned to Fleurs d’hiver Ltd for these reasons, no refund will be issued.
If delivery is not made within 30 days for individual Customers (unless otherwise agreed in writing), they have the right to cancel the order and receive a full refund following the Consumer Rights Act 2015.
Article 7 – Product Storage Conditions
The Customer agrees to follow the storage conditions indicated on the product packaging or as instructed by Fleurs d’hiver Ltd. Any failure to comply with these conditions leading to product deterioration will not engage the responsibility of Fleurs d’hiver Ltd. Products should be stored in a dry place, away from heat, and humidity.
Article 8 – Right of Withdrawal
8.1 – For Professionals
No right of withdrawal applies to orders placed by professional clients.
8.2 – For Individuals
In accordance with UK consumer protection laws, individuals have a right of withdrawal within 14 days for standard products, except for:
- Personalized products, including those with custom labels or flavors, or products made to the Customer’s specifications;
- Unsealed products for hygiene or health protection reasons.
To exercise this right, the Customer must contact Fleurs d’hiver Ltd at info.fleurs.dhiver@gmail.com within the specified period. Returned products must be in perfect condition, in their original packaging. Return shipping costs are the responsibility of the Customer. Refunds will be processed within 14 days of receiving the returned item in satisfactory condition.
Article 9 – Alternative Dispute Resolution (ADR)
In the event of a dispute, the Customer may use an Alternative Dispute Resolution (ADR) scheme before initiating legal proceedings. More details can be provided upon request.
Article 10 – Disclaimer
The products offered by Fleurs d’hiver Ltd are for food consumption only. They are not intended for therapeutic, medical, or preventive use. For any health concerns or medical advice, Customers are advised to consult a qualified healthcare professional.
Article 11 – Disputes
In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. For professional clients, disputes fall under the exclusive jurisdiction of the commercial courts of England and Wales. For individual clients, the competent courts will be those of the Customer’s place of residence.
Article 12 – Data Protection
Fleurs d’hiver Ltd is committed to complying with UK GDPR regulations regarding the protection of personal data. Customers have the right to access, correct, and delete their personal information by contacting info.fleurs.dhiver@gmail.com.
These T&Cs are written in English. In case of translation, only the English version shall prevail. These T&Cs are governed by UK law.
